“Bring in the Brains”: Relevant Incentives • If the regional headquarters or research and development (R&D) institutions of foreign companies need to hire senior managers; urgently needed master’s or higher degree holders; employees with bachelor’s or higher degree; or senior special-professional-certificate holders (all younger than 45 years of age), they should apply to the Human Resource and Social Security Administrations of the districts or counties (including Beijing Economic-Technological Development Area) where the regional headquarters or R&D institution are located under regulations contained in Beijing’s Incentive Management Regulations on Bring-in the Brains, [2005]18, issued by the General Office of the People’s Government of Beijing Municipality. • The regional headquarters that employ foreigners to work in the city may apply to the municipal Human Resources and Social Security Administration for either Foreign Employment Permits or Foreign Employment Certificates. • Deputy general-managers or those with equal rank who have been continually in their positions for more than two years may qualify for incentives in accordance with Beijing’s Incentive Management Regulations on Bring-in the Brains, [2005]18, issued by the General Office of the People’s Government of Beijing Municipality.
Personnel Mobility • Foreigners employed by regional headquarters may qualify for multiple-entry visas with confirmation letters signed by the Beijing Municipal Bureau of Commerce and related documents. Foreign senior managers of regional headquarters, such as legal representatives, general-managers, deputy general-managers, chief financial officers and technicians may apply for multiple-entry F visas valid for no longer than five years by presenting their companies’ business licenses (copy) and temporary residence records. Mid-level managers, such as department managers and technicians, may apply for three-year multiple-entry F visas; common foreign employees can apply for one-year multiple-entry F visas. Spouses and minor children of the above personnel may apply for similar F visas. Foreign L or X visa holders who are employed by a regional headquarters may apply, if necessary, for F visas in accord with the temporary entry application terms stated above. Foreigners employed by regional headquarters who come to China to meet urgent, short-stay business needs without visas signed by China’s embassies and consultants abroad may apply for a visa at the Beijing Capital International Airport by showing relevant documents and certificates produced by the companies or organizations that have invited them. The inviting companies or organizations shall comply with record-keeping procedures in advance at the Visa Office of the Capital International Airport under the Beijing Municipal Bureau of Public Security by showing confirmation documents signed by the Beijing Municipal Bureau of Commerce. • Foreign senior managers of regional headquarters, such as legal representatives, general-managers, deputy general-managers, chief financial officers or technicians, if justified by need, may apply for Foreign Residence Permits with a validity of five years by producing their Foreign Employment Certificate or Foreign Expert Certificate. Common foreign employees may apply for Foreign Residence Permits valid for three-years. Spouses and minor children of the above personnel may apply for Foreign Residence Permits of the same duration. The duration of the permits shall not exceed the validity of a passport. Senior managers of regional headquarters may apply for Foreign Permanent Residence Permits with priority according to the relevant regulations.
• Chinese employees of regional headquarters, who need to go to Hong Kong or Macao for business, may apply for Hong Kong and Macao Entry Permits and multiple-entry business visas by providing documents with instructions from the Taiwan Affairs Office of the State Council and travel permits issued by Taiwan; the Chinese employees of regional headquarters who have to go to Taiwan for business purposes may apply for a Taiwan Pass for mainland residence with priority.
《关于鼓励跨国公司在京设立地区总部的若干规定》的实施细则(三)人才引进和奖励(一)地区总部及其研究开发机构聘用的高级管理人员,和引进北京市急需紧缺的具有硕士及以上学位或具有本科及以上学历且取得高级专业技术职称的人员,且年龄在45周岁以下的,可向地区总部所在区县(包括北京经济技术开发区)人力资源和社会保障局申请办理人才引进;聘用具有学士及以上学位或取得中级及以上专业技术职称的人员,可向地区总部所在区县(包括北京经济技术开发区)人力资源和社会保障局申请办理《北京市工作居住证》。 (二)地区总部聘用外籍人员在北京市就业的,可由地区总部向北京市人力资源和社会保障局申请一并办理外国人就业许可和《外国人就业证》。 (三)地区总部的连续两年以上担任副总经理以上职务或相当职务的人员,按照京政办发 [2005]18号《北京市吸引高级人才奖励管理规定》及相关规定享受奖励政策。
人员流动(一)地区总部外籍人员凭市商务委的确认函和有关证明,可享受多次出入境便利。地区总部的法定代表人、总经理、副总经理、财务总监等外籍高层管理和技术人员,持营业执照(副本)、临时住宿登记等有关证明,可以申请办理不超过5年多次入境有效的F字签证;部门经理等中层管理和技术人员,可以申请办理不超过3年多次入境有效的F字签证;一般外籍员工可以申请办理不超过1年多次入境有效的F字签证。上述外籍人员的外籍配偶及未成年子女,可以申请与上述人员相同期限的F字签证。 受聘于地区总部的持L、X字签证入境的外籍人员,可根据需要,按照上述临时入境办理条件申请F字签证。 地区总部的外籍人员急需短期来华,未及在中国驻外使领馆办理签证的,持邀请单位函件及有关证明,可在北京首都国际机场口岸申请签证,邀请单位应持北京市商务委员会颁发的确认证书事先在北京市公安局首都机场口岸签证处办理备案手续。 (二)地区总部的法定代表人、总经理、副总经理、财务总监等外籍高层管理和技术人员,需要在京常住的,提供《外国人就业证》或《外国人专家证》等相关证明材料,可以申请办理有效期5年的外国人居留许可;部门经理等中层管理和技术人员,可以申请办理有效期4年的外国人居留许可;一般外籍员工可以申请办理有效期3年的外国人居留许可。上述外籍人员的外籍配偶及未成年子女,可以申请与上述人员相同期限的外国人居留许可。以上居留许可期限不得超过其护照有效期。 地区总部的高级管理人员按照有关规定可优先办理《外国人永久居留证》。 (三)对地区总部的中国籍员工因商务需要赴香港、澳门的,可以申请办理《往来港澳通行证》和多次出入境有效的商务签注;对地区总部的中国籍员工因商务需要赴台湾的,如提供国务院台办批件和台湾地区旅行证,可优先办理《大陆居民往来台湾通行证》。 (四)北京市公安局负责受理以上出入境便利、外国人居留许可、赴台港澳通行证等相关申请。
