Implementation Measures of the "Rules of the People's Republic of China on Customs Protection of Intellectual Property Rights"

Main Contents:  These measures are formulated in accordance with the Customs Law of the PRC and other laws and regulations in order to effectively implement the Rules of the PRC on Customs Protection of Intellectual Property Rights.

Significantly, these measures specify the two separate procedures by which PRC Customs should investigate and handle intellectual property cases, which are (i) according to the request of the intellectual property owner, and (ii) by Customs authority. 

In addition, the measures address the different treatment afforded those intellectual property owners who have and have not recorded their intellectual property rights with the PRC Customs.
