Anti-dumping Regulations of the People's Republic of China (Revised) (the Revised Regulations)

Issued: March 31, 2004

Effective: June 1, 2004

Issuing Authority: The PRC State Council

Main Contents: The Revised Regulations, which stipulate that the Ministry of Commerce (MOFCOM) shall be the sole competent authority with regards to anti-dumping in China, officially introduce the term "public interest,"and require that the imposition of anti-dumping duty conform to the "public interest." In addition, MOFCOM must take the "public interest' into consideration when deciding whether to accept a price commitment.

The Revised Regulations also provide that MOFCOM may adopt necessary measures, such as importation registration, after the initiation of anti-dumping investigations for the purpose of the possible retroactive imposition of antidumping duties. 

Moreover, in the event that a price commitment agreement is reached between an exporter and the investigation authority, but the relevant exporter still requests for the investigation into dumping and injury to continue, the investigation authority shall continue such investigation.  Previously, in such circumstances the investigation authority could determine whether or not to continue at its own discretion.
